Chapter Two - Roles and Responsibilities
This chapter summarizes the roles and responsibilities of the official
actors in the administration of this ordinance.
II.A. Board of Supervisors (Board). The board adopted this ordinance and
the Comprehensive Plan for NE Santa Cruz County it implements. Its duties
in the administration of this ordinance shall include, but are not limited
to:
- appointing the commission, the board of adjustment, and the
administrator;
- setting application and inspection fees, as required by III.G and
VIII.H.;
- reviewing proposed plat amendments, as required by III.I.4, and
proposed final plats, as required by III.J.9, including hearing appeals
from commission action on proposed final plats;
- acting on proposed amendments to this ordinance, as provided by
III.W.; and
- accepting required improvements, as provided by VIII.G.
II.B. Planning and Zoning Commission (Commission). The commission shall be
appointed as provided by §11-803, ARS, et seq. Its duties in the
administration of this ordinance shall include, but are not limited to:
- acting on referrals from the administrator, as provided by III.I.5;
- reviewing and approving, conditionally approving, or rejecting
applications for Class II permits, as provided by III.J; and
- reviewing and making a recommendation to the board on proposed
amendments to this ordinance, as provided by III.W.5.
II.C. Board of Adjustment (BOA). The BOA shall be appointed as provided by
§11-807, ARS, et seq. Its duties in the administration of this ordinance
shall include, but are not limited to:
- hearing appeals from decisions of the administrator, as provided by
III.I.6 and IV.C;
- hearing appeals from decisions of the commission, as provided by
III.J.8;
- reviewing and approving, conditionally approving, or rejecting
applications for variances, as provided by III.O; and
- hearing appeals of violation notices, as provided by III.U.2.b.
II.D. Administrator. The board shall retain an administrator who functions
as the "zoning inspector" provided for by §11-808, ARS, and is responsible
for:
- assisting the public in understanding the applicability and
requirements of this ordinance;
- accepting applications for Class I permits for the development of
nonconforming lots, as provided by I.E.3, and issuing permits for
replacement or enlargement of nonconforming structures as provided by
I.F.3;
- preparing the application forms required by III.F and accepting
applications for permits, appeals, variances, and amendments;
- reviewing and approving, conditionally approving, rejecting, or
referring applications for Class I permits, as required by III.I;
- preparing, or contracting for the preparation of, professional
reports on applications for Class II permits and proposed amendments,
as provided by III.J.4 and III.W.3;
- working with developers and the commission to schedule
preapplication reviews, site visits, and hearings, and providing notice
of hearings, as required by III.J.3., III.N.3, III.O.2, and other
provisions of this ordinance, including maintaining lists of
individuals, agencies, or organizations who desire notice of certain
decisions;
- preparing the decision notices required by III.I.3, III.J.7,
III.N.5, III.O.5, and other provisions of this ordinance;
- issuing certificates of compliance as required by III.T;
- investigating possible violations of this ordinance, issuing notices
of violation as provided by III.U, and working with the county attorney
to remedy violations that cannot be resolved via administrative
procedures;
- inspecting, or arranging for the inspection of, required
improvements, as required by VIII.G;
- accounting for fees collected in the administration of this
ordinance and preparing an annual report summarizing development
activity in NE Santa Cruz County; and
- performing all other duties assigned by this ordinance and
assisting the board, commission, and BOA in the execution of their
duties.
II.E. County Attorney. The county attorney shall enforce the requirements
of this ordinance when administrative efforts have failed, as provided by
III.U. The county attorney is also responsible for the review of
development agreements and maintenance mechanisms required by Chapter 8.
II.F. Liability. No individual, including supervisors and commission
members, the administrator, and other county employees, who acts in good
faith and without malice in performing duties assigned by this ordinance
shall be held liable for errors or omissions in its administration. A suit
brought against such an individual shall be defended by the county and any
judgment resulting from such a suit shall be a liability of the county.
